Start a game as Black against the AI from a position where Black is first to move, e.g.
rnbqkbnr/ppp2ppp/8/3pp3/3PP3/8/PPP2PPP/RNBQKBNR b KQkq -

As expected, Black gets to make the first move.

Resign the game and start a rematch.

As the human player you will now be White and you are expected to make the first move. Expected behavior would be for Black (the AI) to make the first move.
