Perhaps make it a top level one.
The rationale behind that is you have to be intentionally looking for the list of osu! rules to reach it, which (significantly, in my opinion) lowers a person's chance to read the rules.
You may joke all you want (and I would even agree), but most of people I've had to deal with as a chat moderator asked where the rules were; maybe it's because they're hidden in a "Help" dropdown, which is not very help-ful.
If it were to be top level, another category would likely have to be removed. Open to suggestions, but doesn't seem feasible.
I've quickly duplicated "home" to see if the whole row really challenges readability, and, in my opinion, it does not, and it's good to go:
if that doesn't sit with you, could probably move the link to rules into "home" category (at least it's more intuitive).
EDIT: for the record, my resolution is 1440x900, and the top row with categories eats less than a half of it (about 600px)
In my opinion, adding a link to Rules article in the download page should be high priority, as currently it's hard for new users to even acknowledge that rules exist
I can't imagine this would help very much, people aren't gonna randomly decide to read all of the rules for fun (most of the time)
what would be helpful is more references to individual rules where they apply, for example the quick note about SFW avatars on the upload form gives users all the info they need without having to read an extra document
